The Hon’ble Allahabad High Court at Judicature in the case of Mi Industries India Private Limited held that the impugned adjudication order dated January 10, 2024 confirming GST demand of Rs. 9,42,21,714.94 suffers jurisdictional error by travelling far beyond the proposed demand of Rs. 1,71,79,347.92 in the show cause notice.
The Hon’ble Allahabad High Court in the case of M/S Meerut Steels held that the question of jurisdictional overlap in parallel proceedings under Central GST and State GST Acts is not a pure question of law but involves factual adjudication, and therefore the writ petition challenging the Central GST order before the High Court is not maintainable. The Petitioner may raise the issue through statutory appeal.

The Hon’ble Allahabad High Court in Jagjit Enterprises (P.) Ltd. quashed an order passed under Section 73 of the UPGST Act without giving any opportunity of personal hearing to the petitioner, following the rationale of the Division bench of the same Court in Mahaveer Trading Company v. Deputy Commissioner, State Tax, Writ Tax No. 303 of 2024 dated March 4, 2024.
