The Central Board of Indirect Taxes and Customs issued an Instruction No. 09/2024 – Customs dated 22.04.2024 regarding extension period of 3 months to Ortho-phosphoric Acid which is used for manufacturing of Fertilizers from applicability of BIS standard IS 798-2020 implemented through QCO dated 13.05.2022.
Reference is invited to Department of Chemical and Petrochemical, Ministry of Chemical and Fertilizer’s Ortho Phosphoric Acid (Quality Control) Order, 2021 dated 15.06.2021, amendment notification S.O. No. 4914 (E) dated 29.11.2021, S.O. No. 2225 (E) dated 13.05.2022 and S.O. No. 1709 (E) dated 13.04.2024 (copies enclosed).
2. Now, vide amendment notification S.No. 1709 (E) dated 13.04.2024, following proviso has been inserted in Ortho Phosphoric Acid (Quality Control) Order, 2021: “Ortho Phosphoric Acid when used as raw material in production of fertilizers, has been exempted from BIS Standard IS 798: 2020 for a period of ninety days from the date of publication of this notification”.
3. In this regard, it is requested that necessary action may be taken to sensitize officers under your jurisdiction regarding the above matter.
4. The difficulties, if any, may be brought to the notice of the Board.
