The Hon’ble CESTAT upheld that SCN issued by the department for the recovery of an erroneous refund. This decision came even after the matter was ultimately held in favour of the revenue by the Hon’ble SC, despite the taxpayer having received a favourable ruling from the HC. Read more

The appeal filed against the aforesaid order has been dismissed on the ground of limitation only. Bar of limitation may bar the remedy of appeal but it does not bar the petitioner’s right to seek his constitutional remedy under Article 226 of the Constitution of India, particularly when the impugned order affects valuable rights of the petitioner and the same has been passed without assigning any reason. DGGI busts Rs.80 crore GST evasion by peanut butter companies in Gujarat

DGGI,, Ahmedabad Zonal Unit, uncovered that these companies misclassified chocolate-flavored peanut butter, taxed at 18%, as plain peanut butter, taxed at 12%, resulting in a 6% tax evasion. These raids uncovered alleged tax evasion of Rs.80 crore and led to an immediate recovery of Rs.5 crore. Read more
