The Hon’ble Delhi High Court in the case APN Sales and Marketing held that an order which does not provide sufficient reasons is not legally sustainable as it is in violation of principles of natural justice and the allegations mentioned in the Show Cause Notice were not mentioned in the Order.

State-Tax Officers authorised can act as ‘proper-officer’ for IGST Act

The Hon’ble Orissa High Court in the case of Narayan Sahu held that officers of State Tax are authorized to be Proper Officers as per Section 4 of the IGST Act. The officers of State Tax are authorized to be proper officers under IGST Act subject to exceptions and conditions to be notified by the Government. Noting that there was no notification to limit the State Tax authorities to cross-authorize on IGST matters, dismisses the petition accordingly and upholds the order

The Hon’ble Madras High Court in the case Tvl. Spark Bio Gas (P.) Ltd held that an order released without giving proper notice is contrary to principles of natural justice. 

High Court has power to condone delay in filing appeal

The Hon’ble Punjab & Haryana High Court in the case of Vasudeva Engineering held that provisions under Section 107 of the CGST Act are not condemnable to Limitation Act, 1963 and therefore, delay cannot be further condoned. However, High Court under Article 226 of the Constitution of India has powers to condone delay in filing appeal.

Retailers urge FM and GST Council not to go for higher 35 pc tax rate

Indian Sellers Collective, an umbrella body of trade associations and sellers across the country, has urged the finance minister and the GST Council not to accept some of GST rate rationalisation suggestions, including the proposal for inclusion of a special rate of 35 per cent on some products. The sellers body is of the view that a fifth GST slab of 35 per cent on demerit goods such as aerated beverages, cigarettes and tobacco, and pricing-based rate structure will materially and fundamentally alter the country’s GST framework with devastating outcomes.
