Limitation period for filing appeal would commence from date of service of order-in-original

👉 Issue:-

✔️ Is it right – the limitation for filing appeal shall commence from date of actual service, not original date of order?

👉 The Hon’ble High Court Judgement:-

✔️ Where an order-in-original remained unserved due to non-delivery and was subsequently delivered, limitation for filing appeal shall commence from date of actual service, not original date of order.

A trap for the taxpayers in GST wherein apparently five provisions are simultaneously applicable for levy of penalty/recovery..

One of the plight for taxpayers in GST is that there are apparently five provisions (without including the provisions of fraud, or wilful misstatement etc) which charge them for delayed payment of Tax and ground reality is that these provisions are being invoked arbitrarily with a complete lack of clarity at ground level. The provisions are as follows-

No attachment of bank account after statutory pre-deposit of 10% of the disputed tax demand under Section 107 of the GST Act

The Hon’ble Andhra Pradesh High Court in the case of Wingtech Mobile Communications India Pvt. Ltd. held that the recovery and attachment of bank accounts after payment of the statutory pre-deposit of 10% of the disputed GST demand under Section 107 of the CGST Act, is impermissible, and directed the Respondents to refund the excess amount recovered, subject to safeguards protecting revenue interests.

Circular Restricting ITC Refund Claims filed after July 18, 2022, IDS violative of Article 14 of the Constitution

The Hon’ble Rajasthan High Court in the case of Shree Arihant Oil and General Mills held that Circular No. 181 dated November 10, 2022, which restricts refund claims on ITC for applications filed after July 18, 2022, for goods under inverted duty structure such as mustard oil, is illegal, arbitrary, and violative of Article 14 of the Constitution, and inconsistent with Notification No. 09/2022-Central Tax (Rate) and Section 54 of the CGST Act, 2017.
